By booking, paying for, participating and/or being a part of a tour or any event (as a passenger, guest or otherwise) promoted, created, managed, administered or otherwise facilitated with Slovenia Explorer (a brand of Proteus d.o.o.), You (as that term is defined herein) agree to and accept the following terms and conditions. This agreement is between You, the participating passenger(s), the person or entity who booked and/or is paying Slovenia Explorer and/or or any agent that is booking and/or paying Slovenia Explorer in your or any passenger’s name (henceforth individually and collectively referred to as “You” or “Your”) and Proteus d.o.o., Slomškova ul. 17, 1000 Ljubljana, Slovenia (henceforth referred to as “Proteus”).


  1. BOOKING AND PAYMENTS

1.1 To make a booking for or otherwise participate and/or be a part of any Proteus tour or event, You hereby agree to the terms and conditions listed below. Your reservation is not guaranteed until You receive a confirmation from Proteus. Proteus accepts a booking on the understanding that full payment has been/will be collected and held either by Proteus directly, or by one of our authorized sales agents or partners.

1.2 Upon confirmation from Proteus, Proteus will reserve a space for You on the selected trip or event. It is Your sole responsibility to check the accuracy of the booking and the dates of travel. Proteus reserve the right to accept or reject any booking for any reason, including but not limited to Your failure to make timely payments to Proteus, Your cancellation or rescheduling of the trip or event or the lack of space on the desired trip or event.

1.3 Once Your online booking is complete in all respects, Proteus will issue You a confirmation voucher and send it to the email address You have provided. Please contact us if You do not receive a booking confirmation, as it might mean that Your order has not been successfully processed or there are internet communication problems. If You do not receive a written confirmation, please check Your junk email folder to see if the email has landed there, then please also check that the email address You entered was indeed the correct one. If You have not received the written confirmation from Proteus, please email us at info@slovenia-explorer.com giving us Your full name, the tour or event You booked (including as much specifics (time, date, etc.) as possible) and request that Proteus resend You the confirmation voucher.

1.4 We accept Visa and MasterCard.

1.5 By booking any product through the Proteus website, You grant Proteus permission to contact You directly by email.


  2. DESCRIPTION OF SERVICES

2.1 Proteus offers day trips, weekend breaks, specials, day trips packages and tours with transportation, professional guides, attraction fees as stated in day trip’s itinerary.

2.2. Weekend breaks and tours can be booked with accommodation, which is, upon agreement with You, booked by Proteus and provided by a third party – accommodation providers.


  3. CONTRACTING PARTIES

3.1 The booking conditions detailed herein contain the entire contract between You and Proteus. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.

3.2 Your contract is with Proteus d.o.o. Proteus reserves the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which Proteus may then specify, as if you had agreed to the provisions concerned directly with that company or person.

3.3 In case Proteus acts as a booking agent and contracts directly with coaches, boats, hostels, hotels and other service providers (individually and collectively the “Other Providers”), all bookings with the Other Providers are subject to their terms and conditions and limitations of liability and Proteus makes no warranties or representations or assumes any liability in connection with the activities of the Other Providers. It is important to note that some of the Other Provider may limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Proteus does not accept any responsibility for any loss as a result of such actions or as a result of any act or omission of the Other Providers and You agree that Proteus is not responsible for the acts or omissions of the Other Providers.

3.4 The accommodation arrangements provided by Proteus are contracted to Other Providers. They are subject to the terms and conditions, and limitations of liability, imposed by the Other Providers. All arrangements are made independently of Proteus, regardless of the booking of such arrangements by Proteus.


  4. PASSENGER RESPONSIBILITIES

4.1 It is Your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on Your person for Your selected trip. Proteus is not liable for any problems, delays or denied entry in the event You are not in possession of valid travel documents.

4.2 EU nationals holding a passport or national ID card are not required to show a passport or national ID card if traveling from one border-free Schengen country. For Australian, British, Canadian or American nationals it is required to hold a passport valid for three months beyond the length of stay and issued within the past 10 years. Croatia, Bulgaria, Cyprus, Ireland, Romania and the UK are not a part of the Schengen area, so a passport or ID card is required if traveling to/from these countries.

In case You are not sure whether you need a visa to enter the Republic of Slovenia, check with the Ministry of Foreign Affairs. Third-country nationals must hold a visa in order to enter the Republic of Slovenia.

4.4 You agree to comply with the authority and direction of the Proteus guides or Proteus office support, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions.

4.4 There may be times when the Proteus guide must make a decision for the safety and/or the best interests of the group. It is a condition of booking that You comply with the authority and decisions of the Proteus guide and You do agree to comply with such authority and decisions. If You do not comply, or if in the good faith opinion of the Proteus guide You are not compatible with the general enjoyment of the group or the smooth operation of the tour (for reasons including but not limited to intoxication, lewd or inappropriate language or behavior, etc.), Proteus reserves the right to refuse to allow You to continue with the tour or the event. You agree that Proteus has the exclusive right to dispel and remove You from a tour or event anytime, without any claims or complaints by You against Proteus. In such a case Proteus will not be liable for any refund, compensation, or additional costs incurred by You.

4.5 It is Your responsibility to meet the transportation provided by Proteus at the correct time and location for departure. In the event You miss a planned departure, any extra travel costs incurred are Your sole responsibility and paid by You. Passengers who miss a departure time due to delay or cancellation of incoming transportation are not entitled to a refund. It is Your responsibility to check in with the Proteus office 15 minutes prior to the specified departure time/start of the event. Due to the nature of the services provided, Proteus will not be liable for any damage or costs You may incur if any service departs, starts, arrives or ends later than the specified time, even if as a result You miss a connecting service or some other scheduled event.

4.6 Proteus is not responsible for Your personal belongings. It is Your sole responsibility to look after Your belongings yourself. You agree that Proteus is not responsible for loss, theft or damage to any of Your personal belongings, regardless of the circumstances.

4.7 The products offered by Proteus are day trips, city breaks, specials and tours consisting of transportation, guidance and (if arranged) accommodation. Proteus guides cannot offer constant special attention or assistance should You have any physical disability requiring such attention without prior arrangement. In such circumstances, it is within Proteus rights to refuse to allow You to continue with the tour of the event.

4.8 You agree that Proteus may take photographs and films of You while You are participating on a Proteus trip. You agree that these photographs and films may be used for marketing and promotional purposes by Proteus. These photographs and films may be used in, but are not limited to, brochures, websites, print media and promotional videos. These photographs and films may be used for publicity and advertising without Proteus obtaining further consent from You or making any payment to You in connection with the permitted uses.


  5. LOCAL PROVIDERS

5.1 You will have the opportunity to purchase Proteus services from local providers at Your chosen destination. These services are not included in the price of your travel package (unless otherwise stated). You are responsible for any additional costs.

5.2 Services from local providers purchased by You are run by local operators and You are subject to their terms and conditions.

5.3 Services from local providers purchased through Proteus are non-refundable and non-transferable. It is Your responsibility to meet the tour or event at the designated departure point and time.

5.4 It is Your responsibility to keep track of any local providers’ vouchers or tickets issued to You by Proteus. Lost vouchers or tickets cannot be replaced.


  6. INSURANCE

6.1 There is no travel insurance included in the cost of any Proteus tour, event or package, ticket or product. You acknowledge that any insurance that You wish to obtain in connection with any Proteus tour, event or package is Your sole responsibility.

6.2 Nevertheless, Proteus highly recommends that You purchase Your own travel insurance that covers all of Your travels. Proteus strongly recommends that You are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, personal baggage, money and public liability.

6.3 Travel Guarantee
Our company is insured for insolvency. This guarantees the amount that You paid in booking Your travel package as well as Your repatriation in the event of insolvency by Proteus. You agree that this is the only amount that Proteus is liable to pay to You in connection with the tour, event or package that You book.


  7. WEATHER, ENVIRONMENTAL AND POLITICAL CONDITIONS

7.1 Proteus is not responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be canceled or changed by You at any time on the basis of weather conditions.

7.2 Proteus is not responsible for delays due to labor disputes, border problems or other political factors.

7.3 Proteus is not responsible for delays due to mechanical failure, or other issues that may arise and are outside of Proteus’ control.


  8. CANCELLATIONS/CHANGES

Depending on the time of cancellation the following cancellation costs apply:

8.1 For Scheduled small group daytrips:

  • 100% of the deposit will be refunded for cancellations up to 24 hours before departure.
  • None (0%) of the deposit will be refunded for cancellation with less than 24 hours’ notice before the departure or no-show.

8.2 For Private daytrips:

  • 100% of the deposit will be refunded for cancellations up to 3 days (72 hours before departure).
  • None (0%) of the deposit will be refunded for cancellation with less than 3 days (72 hours’) notice before the departure or no-show.


8.3 For Multiple-day private tours:

Full payment is required  30 days before departure.
  • Cancellations more than 60 days before departure: 100% of the deposit will be refunded.
  • Cancellation between 59 and 31 days before departure: 50% of the deposit will be refunded.
  • Cancellations between 30-20 days before departure: 50% of the full payment will be refunded.
  • Cancellations between 19-10 days before departure: 20% of the full payment will be refunded.
  • Cancellations between 9-3 days before departure: 10% of the full payment will be refunded.
  • Cancellation on less than 3 days (72 hours) notice before departure or no-show: 0% of 0% of the full payment will be refunded.


The value of the transaction may be subject to taxes, duties, foreign transactions, currency exchange, or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on slovenia-explorer.com and Slovenia Explorer affiliated websites, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees.

8.4 No refunds will be made in respect of any unused portion of a ticket or partially completed trip.

8.5 Although unlikely, tours may be canceled/changed by Proteus due to a lack of the minimum number of participants or other unforeseen circumstances. Proteus reserves the right to cancel/change tours up to but not more than 12 hours prior to the time of departure. In the event a tour is canceled/changed, You will be notified via email or phone. In the event of a cancellation by Proteus You will receive a full refund for the amount paid.

8.6. Should You not be able to attend a tour or event, or we are unable to offer a tour or event, due to a circumstance beyond our control or a force majeure event, Proteus has no responsibility for tour cancellations, and You will not be entitled to any refunds.


  9. COMPLAINTS PERIOD

9.1. You must notify Proteus in the shortest amount of time possible of any irregularities that might occur during a tour or event. Proteus’ responsibility is to eliminate any such irregularity in the shortest amount of time possible.

9.2. In the event that any irregularities were not eliminated on the spot, You can complain and request a refund or compensation after completion of a tour or event. You need to file a complaint in written form in no more than two (2) months after the completion of a tour or event.

  11. APPLICABLE LAW & JURISDICTION

11.1. Proteus services are governed exclusively by the substantive laws of the Republic of Slovenia to the exclusion of conflict of law legislation as well as international law. The courts of Ljubljana, Slovenia, shall have exclusive jurisdiction for all disputes. To the extent permitted by law, the courts of Ljubljana shall be competent.


  12. PRIVACY POLICY

12.1. Proteus respects the privacy of the visitors of its website and ensures that the personal information you submit to us will be treated confidentially. Processing of personal data is carried out in agreement with the requirements set by the Personal Data Privacy Law of the Republic of Slovenia.


  13. FINAL PREMISES

13.1. Participation in any of our tours, events, and/or services is strictly voluntary. As in all human endeavors, there is a level of risk. We do our best to keep the risk at a minimum. Proteus, its contractors, parent and subsidiary companies, and employees assume no liability or responsibility for any injury, loss, damage, inconvenience, sustained by any person using its services. We will not be held in any way responsible for injuries to body, person, or property incurred during the tour. We reserve the right to deny participation to anyone for any reason at any time.
